Mediaite: "Rape Victim Nancy Mace Suggests Cornell 7's Jane Doe Was a Willing Participant in 'Consensual Gangbang'"

Mediaite's Jennifer Bowers Bahney reported on October 9, 2026 that Rep. Nancy Mace posted on X, 'IDK who needs to hear this, but a consensual gangbang is not a rape,' as the Cornell 'Jane Doe' case dominated the news. Mace's post names no case. Here is the post, the reporting, and the words Mace has spoken on rape, each in its own source.

The post

At 9:19 PM on October 8, 2026, Rep. Nancy Mace posted this on X:

Nancy Mace's October 8, 2026 post on X: "IDK who needs to hear this, but a consensual gangbang is not a rape." The post, captured logged out the next morning. X marks it "Last edited."

The post does not name a case. Mediaite reads it as a comment on the Cornell "Jane Doe" case, writing in its headline that Mace "suggests" the plaintiff "was a willing participant." That is Mediaite's framing of the post. Mace's words state a general rule, and she has not said in the post what happened at Cornell.

What the reporting says

According to Mediaite, the post came a day after TMZ published new text messages between the plaintiff and one of the accused fraternity members, Jonathan Newell. Mediaite also reports that New York Gov. Kathy Hochul has appointed Attorney General Letitia James to examine the case, after questions about how Cornell University and the Tompkins County District Attorney's office handled it.

The underlying case is a civil lawsuit. As the Associated Press reported on October 3, a woman identified in court papers as Jane Doe has sued Cornell and seven former students, alleging she was given ketamine and assaulted at the Chi Phi fraternity house in October 2024. The men deny wrongdoing. No one has been charged. All of this is allegation and none of it has been decided by a court.

In Mace's own words, on the record

Mace has made rape, and consent, a public part of her career. Each line below is hers, from the linked source:

  • April 24, 2019, South Carolina House: "For some of us who have been raped, it can take 25 years to get up the courage and talk about being a victim of rape." (dispatch)
  • April 6, 2024, recorded call with Alexis "Ali" Berg (full audio published by FITSNews on June 7, 2026): "There's no way in hell you consented to it based on what I saw. None, zero." On the same call she said, "I've survived a rape at 16." (dispatch)
  • November 19, 2024: "I'm a victim of abuse myself. I'm a rape survivor." (dispatch)
  • October 8, 2026, on X: "IDK who needs to hear this, but a consensual gangbang is not a rape."

Readers can set the lines side by side and judge for themselves. Maceopedia takes no position on what happened at Cornell, which is for the courts and prosecutors to decide.

The allegations Mace has made on the recorded call and elsewhere are her own, are unproven and contested, and are the subject of ongoing civil litigation and a State Law Enforcement Division (SLED) investigation. The people she has named deny them. Mace denies the claims made against her in that litigation. No court has found any of the allegations true or false.
