Marybeth Mullaney

South Carolina plaintiff-side employment and civil rights attorney, founder of Mullaney Law, who serves as counsel of record for plaintiff Alexis Berg in Berg v. Bryant and ADW v. Berg.

Marybeth E. Mullaney is a South Carolina plaintiff-side employment and civil rights attorney and the founder of Mullaney Law, based in North Charleston. She graduated from the University of South Carolina School of Law in 1993 and was admitted to practice in South Carolina that same year, and in New York in 1996. Earlier in her career she served as a public defender in New York City and as an Assistant Public Defender in Charleston County, earning the "Statewide Public Defender of the Year" recognition in 2009. She established her private firm in 2011. She has been selected to Super Lawyers in South Carolina for 2019 through 2022 in the Employment and Labor category.

Her practice focuses on representing employees and sexual assault victims in matters including workplace discrimination, sexual harassment and assault, pregnancy discrimination, wage and hour violations, wrongful termination, FMLA violations, and workers' compensation retaliation.

Connection to the record

Mullaney is counsel of record for plaintiff Alexis Berg in two related Charleston County civil actions: Berg v. Bryant (Case No. 2025-CP-10-03124) and ADW v. Berg (Case No. 2025-CP-10-2671).

In December 2025, Mullaney proposed a confidentiality order that became the subject of a disputed motion in ADW v. Berg. Bryant's filings allege that the drafting and negotiation of that order involved "gamesmanship" and "disingenuous" conduct, and reproduce six weeks of email exchanges with opposing counsel as Exhibit A. Those characterizations are Bryant's allegations, not adjudicated findings; they are contested. Mullaney has stated that any suggestion of improper coordination is "baseless," and denies any wrongdoing. The underlying litigation remains pending.

Mullaney does not represent Rep. Nancy Mace and is not a party to the Mace litigation; she appears here solely in her professional capacity as counsel of record for Berg.
